General rules

We can not know what is legal or illegal in every single country therefore it is up to you as a customer to know the rules. The products we sell are perfectly legal where they are shipped from however we can not ensure that they are legal in your country. You need to study your countries laws and rules before purchasing from us. We will always ship to you no matter what but that is at your own responsibility (this rule does not count for Danish costumers, since we are based in Denmark and can not legally ship certain things. Please see laws below). If you purchase a product from us that is illegal or prohibited in your country then that is on you. When purchasing from PyroHub.eu you automatically agree on that you can NOT hold the company PyricK responsible for your actions and the products you have purchased. PyroHub.eu is only a chemical supplier. As soon as the parcel leaves our warehouse, you have full responsibility for the legality of the products in the parcel(s).

Denmark

PyricK is a Danish VAT registred chemical supplier that has to follow Danish laws. Below you will find information about the legality of our products in Denmark.

Chemicals:

§ 1. Følgende stoffer og produkter må ikke gøres tilgængelige for eller indføres, erhverves, besiddes eller anvendes af fysiske personer, der ikke handler som led i deres sædvanlige virksomhed som handlende eller forretningsdrivende eller deres sædvanlige profession:

1) Koncentreret svovlsyre (H2SO4) og kemiske produkter, der indeholder mere end 50 masseprocent svovlsyre.

2) Salte af chlorat eller perchlorat (ClO3– eller ClO4-) og kemiske produkter med mere end 40 masseprocent chlorat eller perchlorat eller blandinger heraf, som ikke er omfattet af bilag I til Europa-Parlamentets og Rådets forordning (EU) nr. 98/2013 af 15. januar 2013 om markedsføring og brug af udgangsstoffer til eksplosivstoffer.

(BEMÆRK! Vores produkt “Pyro-Liquid” overstiger IKKE 40% KClO4, derfor er den fuldstændig lovlig, og overskrider altså ikke lovgivning på området. At lade vandet fordampe er for nu strengt ulovligt, og vi opfordrer ikke vores kunder til at bryde lovgivningen.)

(BEMÆRK! Du kan ikke som Dansk statsborger købe vores bariumchlorat lovligt. Vi annullerer straks din ordre, hvis du prøver at bestille bariumchlorat til Danmark.)

3) Pulvere med en partikelstørrelse, der er mindre end 200 µm, af metallisk aluminium, magnesium, zink, titan, zirkonium, jern (Al, Mg, Zn, Ti, Zr, Fe) og blandinger eller legeringer heraf samt kemiske produkter, hvoraf sådant pulver udgør mere end 70 masseprocent.

(BEMÆRK! Det betyder, at du som Dansk statsborger IKKE lovligt kan købe et metalpulver med en finere partikelstørrelse end 200µm. Vi annullerer straks din ordre, hvis du prøver at bestille metalpulver med en partikelstørrelse finere end 200µm til Danmark. Vælg dit metalpulver med en større partikelstørrelse end 200µm.)

4) Elementært svovl (S) og kemiske produkter, der indeholder mere end 85 masseprocent svovl.

(BEMÆRK! Vores svovl er tæt på 100%, derfor kan du ikke som dansk statsborger købe vores svovl lovligt. Vi annullerer straks din ordre, hvis du prøver at bestille svovl til Danmark.)

5) Elementært phosphor (P) og kemiske produkter, der indeholder mere end 50 masseprocent elementært phosphor.

Legal penalty for breaking §1

§ 6. Overtrædelse af § 1, stk. 1, straffes med bøde, fængsel indtil 4 måneder eller under skærpende omstændigheder fængsel indtil 2 år.

Legal penalty for breaking ANNEX I or ANNEX II:

Member States shall lay down rules on penalties applicable to infringements of this Regulation and shall take all measures necessary to ensure that they are implemented. The penalties provided for shall be effective, proportionate and dissuasive.

Legality of our products in the European Nation:

Without prejudice to the second paragraph of Article 1 and to Article 13, and unless otherwise provided for in this Regulation or in other legal acts of the Union, Member States shall not, on grounds related to the prevention of the illicit manufacture of explosives, prohibit, restrict or impede the making available of:

(a): the substances listed in Annex I in concentrations not higher than the limit values laid down therein; or

(b): the substances listed in Annex II.

Suspicious Transactions

1. Suspicious transactions involving the substances listed in the Annexes, or involving mixtures or substances containing them, shall be reported in accordance with this Article.

2. Each Member State shall set up one or more national contact points with a clearly identified telephone number and e-mail address for the reporting of suspicious transactions.

3. Economic operators may reserve the right to refuse the suspicious transaction and shall report the transaction or attempted transaction without undue delay, including if possible the identity of the customer, to the national contact point of the Member State where the transaction was concluded or attempted in the event that they have reasonable grounds for believing that a proposed transaction involving one or more substances listed in the Annexes, or involving mixtures or substances containing them, is a suspicious transaction, having regard to all the circumstances and in particular where the prospective customer:

(a): appears unclear about the intended use of the substance or mixture;

(b): appears unfamiliar with the intended use of the substance or mixture or cannot plausibly explain it;

(c): intends to buy substances in quantities, combinations or concentrations uncommon for private use;

(d): is unwilling to provide proof of identity or place of residence; or

(e): insists on using unusual methods of payment, including large amounts of cash.

4. Economic operators shall also report significant disappearances and thefts of the substances listed in the Annexes and of mixtures or substances containing them to the national contact point of the Member State where the disappearance or theft has taken place.

5. In order to facilitate cooperation between the competent authorities and economic operators, the Commission shall, after consulting the Standing Committee on Precursors, draw up, by 2 September 2014 guidelines to assist the chemical supply chain and, where relevant, the competent authorities. The guidelines shall, in particular, provide:

(a): information on how to recognise and report suspicious transactions, in particular as concerns the concentrations and/or quantities of substances listed in Annex II below which no action is normally needed;

(b): information on how to recognise and report significant disappearances and thefts;

(c): other information which may be deemed useful. The Commission shall update the guidelines regularly.

6. The competent authorities shall ensure that the guidelines provided for in paragraph 5 are regularly disseminated in a manner deemed appropriate by the competent authorities in accordance with the objectives of the guidelines.

Reporting of suspicious transactions, disappearances and thefts

1. For the purpose of preventing and detecting the illicit manufacture of explosives, economic operators and online
marketplaces shall report suspicious transactions. Economic operators and online marketplaces shall do so after having
regard to all the circumstances and, in particular, where the prospective customer acts in one or more of the following
ways:

(a) appears unclear about the intended use of the regulated explosives precursors;
(b) appears unfamiliar with the intended use of the regulated explosives precursors or cannot plausibly explain it;
(c) intends to buy regulated explosives precursors in quantities, combinations or concentrations uncommon for
legitimate use;
(d) is unwilling to provide proof of identity, place of residence or, where appropriate, status as professional user or
economic operator;
(e) insists on using unusual methods of payment, including large amounts of cash.

2. Economic operators and online marketplaces shall have in place appropriate, reasonable and proportionate
procedures to detect suspicious transactions, adapted to the specific environment in which the regulated explosives
precursors are made available.

3. Each Member State shall set up one or more national contact points with a clearly identified telephone number and
e-mail address, web form or any other effective tool for the reporting of suspicious transactions and significant
disappearances and thefts. The national contact points shall be available 24 hours a day, seven days a week.

4. Economic operators and online marketplaces may refuse the suspicious transaction. They shall report the suspicious
transaction or attempted suspicious transaction within 24 hours of considering that it is suspicious. When reporting such
transactions, they shall give the identity of the customer if possible and all the details which have led them to consider the
transaction to be suspicious to the national contact point of the Member State where the suspicious transaction was
concluded or attempted.

5. Economic operators and professional users shall report significant disappearances and thefts of regulated explosives
precursors within 24 hours of detection to the national contact point of the Member State where the disappearance or
theft took place. In deciding whether a disappearance or theft is significant, they shall take into account whether the
amount is unusual considering all circumstances of the case.

6. Members of the general public that have acquired restricted explosives precursors in accordance with Article 5(3)
shall report significant disappearances and thefts of restricted explosives precursors within 24 hours of detection to the
national contact point of the Member State where the disappearance or theft took place.
